Avoiding The Legal Landmines In Recruiting And Hiring: A Pro-Active Approach

Recruiting and career services professionals are well aware of the fundamental legal risks inherent in the recruiting and hiring processes. In this changing world, however, we are all facing new challenges:

  • How can you balance a commitment to promoting diversity and principles of equal employment opportunity?
  • When should you "test" applicants and what limitations apply?
  • Is it legal to reject an applicant because of information listed on her "MySpace" page?
  • What information should you include in offer letters to give the organization maximum flexibility, while not discouraging the "best and brightest" from accepting a position?
  • What are some of the various legal issues involved with internship recruiting?

Organizations whose leaders understand how to pro-actively manage the risks associated with pre-employment personnel decisions will continue thriving. Others will fall behind.

Join Jennifer Brown Shaw, partner and co-founder of Shaw Valenza LLP, a boutique California employment law firm, to discuss these issues and more. Jennifer provides regular advice and counsel on workplace issues to private and public sector employers, develops and presents training seminars for management and non-supervisory employees, conducts independent internal investigations for employers, and litigates employment law cases in state and federal court. She is an active member of the California State and Sacramento County Bar associations, the Society for Human Resource Management, the Legal and Legislative Group of the Sacramento Area Human Resources Association, and the Sacramento SPCA Board of Directors. She also co-authors a column on workplace law issues for The Daily Recorder, a legal newspaper.

Named by Northern California Super Lawyers magazine as one of the top attorneys in California for 2009, Jennifer is a frequent speaker on employment law topics, and has been a guest on CNN and local television and radio. After receiving a Bachelor of Arts degree in economics with honors from the University of California, Santa Cruz. Jennifer graduated magna cum laude from the University of San Francisco School of Law, where she was the editor-in-chief of the law review. Before founding Shaw Valenza LLP in 2006, Jennifer was a partner at Jackson Lewis LLP. Previously, Jennifer practiced employment law at Schachter, Kristoff, Orenstein & Berkowitz (1997-2000) and Orrick, Herrington & Sutcliffe (1994-1997).

Goals of Presentation:
Attendees will understand the legal risks associated with recruiting and better hiring activities. We will address the applicant screening process, targeting qualified candidates, how to select candidates for interviews, who is the "most qualified" candidate, and what to do if the organization's needs change after making a job offer.

Program Description:
This program is intended to provide attendees with an interactive and dynamic learning experience to help them gain a better understanding of the legal principles applicable to college recruiting activities. Though a good portion of the information covered will be beneficial for employers, internship recruiting will also be discussed, a topic that is often critical to colleges as well.
